The Role of the Clean Water Act in MS4 Regulation

The Clean Water Act is the foundation of modern water pollution control in the United States. While many people associate the law with industrial pollution or wastewater treatment plants, it also serves as the legal basis for regulating stormwater runoff through Municipal Separate Storm Sewer System (MS4) permits. Every municipality, county, state agency, university, military installation, and other public entity operating an MS4 does so under authority granted by the Clean Water Act.

Understanding how the Clean Water Act led to today's MS4 program helps explain why municipalities must develop stormwater management plans, conduct public education, inspect illicit discharges, and implement best management practices (BMPs). The law transformed stormwater from something once viewed as little more than rainwater into one of the nation's most closely regulated sources of water pollution.

The Origins of the Clean Water Act

The Federal Water Pollution Control Act was originally enacted in 1948, but it had limited enforcement authority and produced few measurable improvements in water quality. Public concern over heavily polluted rivers, contaminated drinking water, fish kills, and highly publicized environmental disasters eventually led Congress to pass sweeping amendments in 1972. Those amendments became what is now commonly known as the Clean Water Act.

The Act established an ambitious national objective:

"To restore and maintain the chemical, physical, and biological integrity of the Nation's waters."

This mission continues to guide federal and state water quality programs more than five decades later.

Why Stormwater Became a Regulatory Focus

When the Clean Water Act was first adopted, regulators primarily focused on pollution discharged from identifiable sources such as factories and wastewater treatment plants. These facilities released pollutants through pipes that could be monitored and regulated relatively easily. Over time, scientists discovered that stormwater runoff was carrying enormous quantities of pollutants into rivers, lakes, wetlands, and coastal waters. Rainfall washing across rooftops, parking lots, roads, construction sites, and developed landscapes collected pollutants such as:

  • Sediment
  • Oil and grease
  • Heavy metals
  • Road salt
  • Fertilizers
  • Pesticides
  • Bacteria
  • Trash
  • Nutrients
  • Automotive fluids

Unlike industrial discharges, stormwater pollution originated from thousands of individual locations across an entire watershed. Collectively, however, it became one of the leading causes of water quality impairment throughout the United States.

The Birth of the MS4 Program

Recognizing the growing impact of stormwater pollution, Congress amended the Clean Water Act in 1987 to require regulation of municipal storm sewer systems. The amendments directed the U.S. Environmental Protection Agency (EPA) to develop a permitting program for stormwater discharges under the National Pollutant Discharge Elimination System (NPDES). Rather than regulating individual storm drains, the program regulates the entire municipal storm sewer system, known as a Municipal Separate Storm Sewer System, or MS4.

An MS4 includes publicly owned drainage infrastructure that conveys stormwater, but is separate from sanitary sewer systems. This infrastructure commonly includes:

  • Catch basins
  • Storm drains
  • Culverts
  • Ditches
  • Swales
  • Storm sewer pipes
  • Retention and detention facilities
  • Municipal drainage channels

The objective is not to eliminate stormwater discharge, but to reduce pollutants to the maximum extent practicable.

NPDES Permits and MS4 Compliance

Under the Clean Water Act, municipalities operating regulated MS4s must obtain coverage under an NPDES permit, or an equivalent state-issued permit where authority has been delegated by EPA. These permits establish the requirements communities must follow to reduce polluted runoff entering receiving waters.

Permit requirements vary by state and permit type but generally include:

  • Development of a Stormwater Management Program (SWMP)
  • Public education and outreach
  • Public participation and involvement
  • Illicit discharge detection and elimination (IDDE)
  • Construction site runoff control
  • Post-construction stormwater management
  • Municipal pollution prevention and good housekeeping

These six program areas are commonly referred to as the Minimum Control Measures (MCMs) and form the core of most Phase II MS4 permits.

Phase I and Phase II MS4 Programs

EPA implemented stormwater regulation in two phases.

Phase I

Beginning in 1990, Phase I regulations applied primarily to:

  • Large municipalities
  • Medium-sized municipalities
  • Certain industrial facilities
  • Construction projects disturbing five acres or more

These communities generally served populations exceeding 100,000 people and operated larger, more complex stormwater systems.

Phase II

Recognizing that smaller communities also contributed significant stormwater pollution, EPA expanded the program in 1999 through the Phase II Stormwater Rule.

Phase II extended permitting requirements to:

  • Smaller municipalities
  • Towns and villages
  • Counties
  • Public universities
  • Transportation agencies
  • Military bases
  • Other publicly owned storm sewer systems located within urbanized areas

Today, thousands of municipalities across the country operate under Phase II MS4 permits.

The Importance of Maximum Extent Practicable (MEP)

One of the most important concepts within the Clean Water Act's stormwater regulations is the requirement that municipalities reduce pollutants to the "maximum extent practicable," commonly abbreviated as MEP. Because stormwater is generated by natural precipitation rather than controlled discharges, municipalities cannot regulate the timing, location, or volume of runoff. Instead, the Clean Water Act requires them to reduce pollutants to the maximum extent practicable through planning, maintenance, public education, and implementation of best management practices. This flexible standard allows communities of different sizes and resources to develop programs appropriate for their circumstances while still making measurable progress toward cleaner waterways.

The Role of States

Although the Clean Water Act is a federal law, most states have received authorization from EPA to administer their own NPDES permitting programs. As a result, municipalities often work directly with their state environmental agencies rather than EPA. State agencies may establish permit requirements that are more stringent than federal minimum standards, provided they remain consistent with the goals of the Clean Water Act. This is why MS4 permits can differ considerably from one state to another, even though they all derive their authority from the same federal law.

Enforcement and Accountability

The Clean Water Act provides multiple enforcement mechanisms to ensure compliance. Municipalities may be subject to inspections, audits, reporting requirements, permit renewals, and enforcement actions if they fail to meet permit obligations.

  • Civil penalties
  • Corrective action requirements

In some cases, citizen groups may also bring legal actions under the Clean Water Act's citizen suit provisions when they believe permit requirements are not being met. These enforcement tools encourage municipalities to maintain active stormwater management programs rather than treating permit compliance as a one-time exercise.

More Than Regulatory Compliance

Although MS4 permits are regulatory requirements, their broader purpose is environmental protection. Effective stormwater management reduces flooding, limits streambank erosion, improves aquatic habitat, protects drinking water sources, preserves recreational waters, and reduces pollutant loads entering rivers, lakes, and estuaries. Many municipalities have discovered that investing in proactive stormwater management also lowers long-term infrastructure maintenance costs while improving community resilience to increasingly intense rainfall events.

The Clean Water Act's Lasting Legacy

More than fifty years after its passage, the Clean Water Act remains one of the most influential environmental laws in American history. Its expansion into stormwater regulation fundamentally changed how municipalities manage runoff and protect local waterways.

Every storm drain, catch basin inspection, illicit discharge investigation, public education campaign, green infrastructure project, and MS4 annual report reflects the Act's enduring goal of restoring and maintaining the integrity of the nation's waters. For communities operating under MS4 permits, the Clean Water Act is more than a legal requirement. It provides the framework for protecting water quality, preserving aquatic ecosystems, and ensuring that future generations inherit cleaner, healthier watersheds than those of the past.
